What is Med-Arb?

Med-Arb is a fusion of mediation and arbitration. The process begins with mediation allowing the parties to take responsibility for their own resolution. If they find they are unable to agree, then the mediator becomes an arbitrator, considering all the discussion throughout the mediation process, and makes a binding decision for them. There is no appeal process.

All processes have their advantages and disadvantages. Whilst it may be tempting to think that the issues may be resolved even if the parties are unable to agree, the risk with Med-Arb is that decisions made by the Med-Arbitrator may reflect their own values and belief system.

Med-Arb must be agreed to prior to beginning any process. Not all mediators will provide Med-Arb so please check first.
